These Terms of Service govern your access to and use of www.floral-masters.com, our online store, and any related products, services, content, features, and tools collectively referred to as the “Services.”

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products and services.

SECTION 2 — FLORAL PRODUCTS AND PRODUCT APPEARANCE

Flowers, plants, greenery, containers, ribbons, decorative materials, and other natural products may vary in appearance.

We make reasonable efforts to display product photographs, colors, descriptions, dimensions, and designs accurately. However, we cannot guarantee that your device will display colors or product details accurately.

Because flowers and plants are natural and seasonal products:

• Colors, sizes, shapes, and stages of bloom may vary.

• Certain flowers or containers may not be available.

• An arrangement may not look exactly like the photograph displayed online.

• The lifespan of flowers and plants may vary depending on freshness, temperature, environment, handling, and customer care.

Product photographs are intended to represent the overall style, value, size, and appearance of an arrangement. Minor differences are not considered defects.

SECTION 3 — FLORAL SUBSTITUTIONS

Flower, greenery, plant, container, and decorative-item availability may change without notice due to seasonal availability, supplier inventory, quality standards, weather, and market conditions.

When necessary, Floral Masters may substitute:

• A flower variety

• A flower color

• Greenery

• A plant

• A vase or container

• Ribbon

• Decorative materials

We will make reasonable efforts to preserve the arrangement’s overall:

• Style

• Color palette

• Theme

• Size

• Quality

• Monetary value

Substitutions may be made without advance approval when necessary to complete and deliver the order on time.

For arrangements designed around a single flower variety or a specific color, we will attempt to contact the customer before making a substantial substitution when reasonably possible.

A substitution of comparable or greater quality and value is not considered a defective or incorrect order.

SECTION 4 — ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer to purchase products or services from Floral Masters.

An order is not considered accepted until:

1. We receive the order;

2. Payment is authorized or processed; and

3. We confirm that we can fulfill the order.

An automated order confirmation only confirms that we received your order. It does not guarantee product availability, delivery availability, or final acceptance.

We reserve the right to refuse, limit, modify, or cancel an order for reasons including:

• Product unavailability

• Delivery limitations

• Incorrect pricing

• Suspected fraud

• Payment problems

• Incomplete customer information

• An incorrect or undeliverable address

• Safety concerns

• Events outside our reasonable control

If we cancel an order after payment has been collected, we will issue an appropriate refund for the canceled portion of the order.

We may limit quantities purchased by any customer, account, household, delivery address, billing address, or payment method.

Products purchased through our website are intended for personal or household use and may not be resold without our written authorization.

SECTION 5 — CUSTOMER INFORMATION AND ORDER ACCURACY

You are responsible for reviewing your order before submitting it.

You must verify that the following information is correct:

• Product selection

• Arrangement size

• Delivery date

• Recipient name

• Delivery address

• Apartment, suite, building, or room number

• Recipient telephone number

• Card message

• Delivery instructions

• Billing information

Floral Masters is not responsible for delays, failed deliveries, or other problems caused by inaccurate, incomplete, or outdated information provided by the customer.

Contacting us to request a correction does not guarantee that the order can be changed, particularly after preparation or delivery has begun.

SECTION 6 — PRICES, PAYMENTS, AND BILLING

All prices are shown in U.S. dollars unless otherwise stated.

Prices, promotions, discounts, delivery fees, service fees, and product availability may change without notice.

The price charged will generally be the price displayed when the order is submitted, subject to correction of typographical, technical, or pricing errors.

Unless expressly stated otherwise, displayed product prices may not include:

• Sales tax

• Delivery fees

• Service charges

• Rush-delivery fees

• Special-handling charges

• Other applicable charges

You agree to provide complete and accurate payment information and represent that you are authorized to use the payment method provided.

If we discover a pricing or product-description error, we may contact you for instructions or cancel the affected order and refund the applicable payment.

Promotional offers may have separate terms, restrictions, expiration dates, exclusions, or minimum-purchase requirements.

SECTION 7 — DELIVERY

Delivery availability is determined by the delivery address, delivery date, order type, and our service area.

Delivery dates and delivery windows are estimates unless Floral Masters expressly confirms a guaranteed delivery time in writing.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

• Traffic

• Severe weather

• Accidents

• Road closures

• Vehicle problems

• Power or internet outages

• Supplier delays

• Government restrictions

• Facility access restrictions

• Incorrect customer information

• Events of force majeure

We may contact the customer or recipient by telephone, text message, or email regarding the delivery.

When the recipient is unavailable, the driver may, when reasonably safe and appropriate:

• Leave the order at the delivery address;

• Leave it with a receptionist, concierge, front desk, doorman, security desk, coworker, neighbor, or authorized person;

• Place it in another reasonably secure location;

• Return the order to the store; or

• Attempt to contact the customer or recipient.

Delivery is considered completed when the order is delivered to:

• The recipient;

• The address provided by the customer;

• An authorized person;

• A reception or security area;

• A reasonably safe location at the delivery address; or

• A facility employee authorized to receive deliveries.

We may use a photograph, delivery scan, driver record, GPS record, recipient signature, or other documentation as proof of delivery.

SECTION 8 — HOSPITAL, FUNERAL HOME, SCHOOL, HOTEL, AND BUSINESS DELIVERIES

Deliveries to hospitals, funeral homes, schools, hotels, offices, gated communities, government buildings, and similar locations are subject to the rules and access restrictions of those facilities.

The customer is responsible for confirming that:

• The facility accepts floral deliveries;

• The recipient is present or registered at the facility;

• The recipient is permitted to receive flowers or plants;

• The correct room, department, service, company, or event information has been provided.

A facility may redirect, hold, reject, or dispose of an arrangement after accepting delivery. Floral Masters is not responsible for how a facility handles an order after delivery has been completed.

For hospital deliveries, certain flowers, plants, containers, or balloons may be restricted in intensive-care units or other departments.

For funeral deliveries, the customer must provide the deceased’s name, funeral home, service date, and service time. We are not responsible for delays caused by incomplete or incorrect service information.

SECTION 9 — INCORRECT ADDRESSES, REDELIVERY, AND FAILED DELIVERY

Additional charges may apply when:

• An incorrect or incomplete address was provided;

• The recipient has moved;

• The recipient is unavailable;

• The delivery location is inaccessible;

• The recipient refuses the order;

• A second delivery attempt is requested;

• The delivery address is changed after dispatch;

• The order must be returned to the store.

Delivery fees and completed delivery services are generally non-refundable.

Orders delivered to the address provided by the customer will not qualify for a refund solely because the intended recipient did not personally receive or locate the order.

SECTION 10 — CANCELLATIONS AND ORDER CHANGES

Cancellation and modification requests must be submitted as soon as possible.

We do not guarantee that an order can be canceled or changed after it has been accepted.

An order may become non-cancelable once:

• Flowers or materials have been purchased;

• Preparation has started;

• The arrangement has been completed;

• A custom product has been created;

• The order has been dispatched;

• Delivery has been attempted;

• The order is scheduled for a major holiday or high-demand period.

Same-day orders, custom arrangements, wedding products, event products, funeral pieces, and special-order products may be final once preparation or purchasing begins.

Approved cancellations may be subject to deductions for products, materials, labor, delivery attempts, payment-processing costs, or other expenses already incurred, to the extent permitted by law.

SECTION 11 — REFUNDS, REPLACEMENTS, AND RETURNS

All refunds, replacements, credits, and eligible returns are governed by our posted Refund Policy.

Flowers, plants, arrangements, and other perishable products generally cannot be physically returned.

Concerns involving damage, poor condition, missing products, or incorrect products must be reported within the time stated in our Refund Policy.

We may require:

• The order number;

• A description of the problem;

• Clear photographs of the arrangement;

• Photographs of the packaging; and

• Other information reasonably necessary to evaluate the claim.

Depending on the circumstances, an approved resolution may include:

• Replacement

• Partial replacement

• Store credit

• Partial refund

• Full refund

The appropriate resolution will be determined based on the nature of the issue and applicable law.

SECTION 12 — CUSTOM, SPECIAL-EVENT, AND PERSONALIZED ORDERS

Custom arrangements, personalized products, special orders, wedding flowers, event flowers, sympathy pieces, funeral pieces, and products purchased specifically for a customer may require advance payment or a non-refundable deposit.

Once design, purchasing, preparation, or production has begun, payments may become non-refundable to the extent disclosed at the time of purchase and permitted by law.

Estimates and proposals may expire and are subject to product availability and market-price changes until an order is accepted and any required payment is received.

Additional terms contained in an event proposal, invoice, contract, or written agreement will also apply. If those terms conflict with these general Terms, the specific written agreement will control for that order.

SECTION 13 — FLOWER AND PLANT SAFETY

Certain flowers and plants may:

• Cause allergic reactions;

• Be harmful if consumed;

• Be toxic to pets;

• Contain pollen, sap, thorns, wires, floral foam, preservatives, or small decorative components.

Flowers and decorative products are not intended for consumption unless expressly identified as edible.

Customers and recipients are responsible for keeping flowers, plants, containers, candles, balloons, floral chemicals, decorative materials, and small components away from children and animals when appropriate.

Anyone with allergies, pets, or specific safety concerns should contact us before ordering.

SECTION 14 — INTELLECTUAL PROPERTY

The Services and their content—including our business name, logos, photographs, floral designs, graphics, text, videos, product names, descriptions, website design, and other materials—are owned by or licensed to Floral Masters and are protected by applicable intellectual-property laws.

You may use the Services only for lawful, personal, and non-commercial purposes.

Without our prior written permission, you may not:

• Copy or reproduce our content;

• Republish or distribute our photographs;

• Modify or create derivative works from our content;

• Use our name, logo, or branding;

• Scrape or extract product information;

• Use our content to train an artificial-intelligence system;

• Sell or commercially exploit any part of the Services.

No ownership or license is granted except for the limited right to use the Services in accordance with these Terms.

SECTION 17 — RELATIONSHIP WITH SHOPIFY

Floral Masters is powered by Shopify, which provides the e-commerce platform used to operate our online store.

However, all purchases made through our store are transactions directly between the customer and Floral Masters.

Shopify is not the seller or merchant of record for Floral Masters products and is not responsible for:

• Our products or services;

• Floral design or product quality;

• Order preparation;

• Delivery;

• Refunds or replacements;

• Customer service;

• Injuries, damages, losses, or claims arising from an order.

To the fullest extent permitted by law, you release Shopify and its affiliates from claims arising directly from transactions between you and Floral Masters.

SECTION 18 — PRIVACY

Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy.

Because our store is hosted by Shopify, Shopify and other service providers may process personal information in connection with operating the Services, processing payments, preventing fraud, fulfilling orders, providing analytics, and improving the shopping experience.

SECTION 19 — CUSTOMER REVIEWS, PHOTOS, AND FEEDBACK

When you submit a review, photograph, comment, suggestion, message, or other content to us, you represent that:

• You own or have permission to submit it;

• It does not violate another person’s rights;

• It is not unlawful, abusive, threatening, obscene, or defamatory;

• It does not contain malicious code or spam.

You grant Floral Masters a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, edit, and share submitted content for operating, improving, and promoting our business.

We may remove or decline to publish content at our discretion, subject to applicable law.

We are not obligated to compensate you, keep feedback confidential, or respond to submitted feedback.

Information on the Services may occasionally contain typographical errors, inaccurate descriptions, incorrect prices, unavailable products, incorrect delivery information, or other omissions.

• Cancel affected orders;

These actions may be taken without prior notice, including after an order has been submitted. If we cancel a paid order because of an error, we will issue an appropriate refund.

We may suspend or terminate access when we reasonably believe these Terms have been violated.

• Product photographs will exactly match delivered natural products;

• Every requested flower or container will be available;

• Every delivery will occur at an exact requested time;

• Flowers or plants will remain fresh for a specific number of days;

• Information on the website will always be complete or error-free.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

SECTION 23 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Floral Masters and its owners, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Services or an order.

This may include loss of profits, revenue, data, business opportunity, enjoyment, or anticipated savings.

Where liability cannot legally be excluded, our total liability arising from an order will not exceed the amount paid for the product or service giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

• False or unauthorized content submitted by you;

• Fraudulent activity conducted through your account.

This section does not apply where indemnification is prohibited by applicable law.

These Terms, together with our posted policies and any applicable written order agreement, constitute the entire agreement between you and Floral Masters regarding the Services.

They replace prior communications or agreements concerning the same subject matter.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, sale, reorganization, transfer of assets, change in ownership, or operation of our business, subject to applicable law.

SECTION 29 — GOVERNING LAW

These Terms and any dispute relating to the Services or an order will be governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Subject to any rights that cannot legally be waived, the parties consent to the jurisdiction of the applicable state and federal courts serving the county in Georgia where Floral Masters maintains its principal place of business.

We may update these Terms from time to time by posting a revised version on our website.

The revised Terms will become effective on the date stated at the top of the page or as otherwise required by law.

Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

Changes will not retroactively alter the material terms of an order already accepted unless required by law or agreed to by the parties.
